5 Things You Should Know About Immigration Law in 2021

As an immigrant, it is fundamentally important that you understand the immigration law to avoid any inconveniences when trying to get into another country. With so many illegal immigrants getting into the country every day, you might find yourself on the wrong side of the law as the Federal government tries to track and deport illegal immigrants if you do not have your papers in order. Having the right knowledge and information about this law enables you to visit the right offices and get the required papers that allow you to live and work in the United States (US). Here are the 5 things you should know about the law.

Green Cards Based on Employment

The Federal government is now issuing green cards based on the points-based plan. According to this plan, individuals will have to exhibit that they have a particular set of skills for them to be eligible. The plan eliminates the possibility of one getting a green card for immigrant investors, or individuals who show the potential of initiating enterprises that could create job opportunities in the country.

Refugee Admissions

The US Congress created the modern refugee program in 1980. This program was to assist people fleeing from persecution in their countries. In 2019, Trump’s administration has capped the number of refugees allowed into the country at 30,000. 11 nations have been deemed as high risk and refugees from these countries will only be allowed on a case-by-case basis.

Diversity Visas

In this program, which is also called the visa lottery, the US grant’s about 50,000 people green cards every year. This program began in 1995, and since then, more than a million people have been given green cards allowing them to live and work in the US. The Trump administration has plans to overhaul this program and give visas to individuals from underrepresented nations in a bid to try and diversify the population immigrating into the country. Countries such as Canada, India, China and Mexico that had the most arrivals of such immigrants have been barred from this program.

Immigration Based on Families

According to this program, an individual can receive a green card if they have a sibling, parent, spouse or child already living in the U.S as a citizen or in some cases, living with a green card. This program brings more immigrants into the US than any other. President Donald Trump is looking forward to having legislation that will only allow immediate family members to enjoy this privilege. The legislation will significantly lower the number of people who will get into the US via this program.

Temporary Permissions

There are a small number of immigrants that receive temporary permissions to live in the US. These are people who have arrived in the country under unusual circumstances and most lack in means of getting legal citizenship. They fall into two categories; the DACA (Deferred Action for Childhood Arrivals) and the Temporary Protected Status. Trump’s administration ordered that DACA should be ended, but existing applicants to remain. There have been no new applicants since the executive order, but the issue is in the Supreme Court. The Temporary Protected Status allows a few select immigrants escaping war and natural disasters to live and work in the US. However, Trump’s administration says it will not renew this program, though it has been challenged in federal courts.
